"This lawsuit is from the County Executive is another foolish waste of taxpayer money," Majority Leader Catherine Borgia (D-Ossining) said.

Astorino is hoping to stop or delay the closure of Indian Point, the nuclear power plant in Buchanan, claiming the state cannot move forward because it did not complete a full environmental review prior to the agreement.

The Westchester Board of Legislators must approve the lawsuit by its May 8 meeting so the county can file the lawsuit in Westchester County Supreme Court.

Borgia said the county should be figuring out how to mitigate the economic, social and environmental impacts of Indian Point closing instead of engaging in a "bogus lawsuit that would make his friend, President Donald Trump, proud."

" As a member of Gov. Cuomo’s Indian Point Closure Task Force, I will continue to advocate for State resources to mitigate economic, job, school district losses and environmental concerns surrounding spent fuel rods,” said Borgia.

Entergy announced it will be closing the plant in 2020 and 2021 ,saying it was not economically viable to keep open.
