McNerney said the weapon police believe was used in the attempted murder of Peter Schmidt Sr., a 22-year veteran of Greenburgh's police force, was found in a grassy portion of the shoulder along the Sprain Brook Parkway near Tuckahoe Road.

McNerney identified Taqiy Walton, 34, of Elmsford "as the subject that shot the gun." Walton has prior felony arrests for reckless endangerment and a violent assault, the chief said.

Walton was arraigned in Greenburgh Town Court on Tuesday afternoon along with Adam Larregue, 20, also of Elmsford. Both were charged with two counts of attempted murder and criminal possession of a weapon. They were sent to County Jail pending another court appearance on July 21.

Greenburgh Judge Arlene Gordon-Oliver granted orders of protection for Peter Schmidt Sr., the retired officer who was shot; his wife, Veronica; and their son, Peter Jr., an active police officer in Greenburgh.

The retired officer was resting at home Tuesday after being treated at Westchester Medical Center for bullet wounds to the right forearm and right turso. "He's been cleared medically,'' McNerney said. "The injuries are not life-threatening."

Police said there are at least four other witnesses to Monday's shooting at 5 Payne Road, where the elder Schmidt interrupted a burglary in progress at the unoccupied home while mowing his lawn nearby.

McNerney said, "The Greenburgh police family is very grateful" for the "brave and intelligent actions. .. of this father-and-son team."

The police chief said that after retiring in 2005, the highly-decorated Schmidt served a year in Mosul, Iraq, training soldiers in 2008.

Schmidt's son, who has served Greenburgh Police for three years, was off-duty during Monday's 3:45 p.m. shooting, but saw a BMW speed off from the scene. The younger Schmidt radioed its license plate number to headquarters and the car was stopped by Yonkers police with assistance from Westchester County and state police in Bronxville, McNerney said.
